On 15 March 2018, a number of our forensic experts from our Singapore and Jakarta offices, including Matthew Fleming, Daniel Tay, Catherine Lee and Panji Wisnu, presented at an event at the offices of respected law firm Assegaf Hamzah & Partners (‘AHP’) in Jakarta.
Ahmad Maulana (AHP) led the discussion on the legal aspects of investigations, data privacy in Indonesia and how personal data is now being used during investigations.
Nigel Pereira from Rajah & Tann Singapore (‘R&T’) touched on the current legal environment and the key issues which corporates are focusing on for 2018, such as anti-corruption laws, SNI ISO 37001:2016, Governance, Deferred Prosecution Agreements and the impact of social media.

Forensic expert Matthew Fleming from KordaMentha shared a series of interview techniques and provided an overview of the types and prevalence of fraud in Asia-Pacific. He spoke about the need for experienced objectivity to assist in maximising evidence collection as internal investigations are often fraught with emotion and that internal investigations can be derailed by the proximity of the investigator to the subject of investigation.

Daniel Tay from KordaMentha gave an overview on electronic evidence and its prevalence over physical evidence which is as much as 98%. He also stressed the importance and methods of preserving data correctly, to support investigations and subsequent court proceedings.
Paul Ng from R&T wrapped up the presentation by sharing his view of the legal environment in Indonesia.
